Please read these terms carefully before using COSI. By accessing or using our platform, you agree to be bound by these terms.

By creating a COSI account, downloading the COSI app, or otherwise accessing any part of the COSI platform, you confirm that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.
If you do not agree to these terms, you must not use COSI. We may update these terms from time to time. Continued use of the platform after changes are posted constitutes your acceptance of the updated terms.
You must be at least 16 years of age to use COSI. By using the platform, you represent that you meet this requirement.
COSI is an Ambient Comfort Intelligence platform that combines physiological data, environmental sensing, and AI to automatically adjust your surroundings — including temperature, lighting, and sound — to keep you in your personal comfort zone.
COSI's services include, but are not limited to:
Some features require COSI hardware (COSI Band, COSI Hub) or compatible third-party devices. COSI does not guarantee availability of any specific third-party integration.
To use COSI, you must create an account using a valid email address. You agree to:
You may not create more than one account per person, or create an account on behalf of someone else without their explicit consent.
COSI reserves the right to refuse registration or cancel accounts at our discretion, including for violations of these terms.
COSI offers two subscription tiers:
All billing is processed securely through Stripe. By subscribing to Pro, you authorise COSI to charge your payment method on a recurring basis (monthly or annual, depending on your selected plan).
Cancellation: You may cancel your Pro subscription at any time from Profile → Subscription → Cancel Plan. Your Pro access will continue until the end of your current billing period. No further charges will be made after cancellation.
Refunds: We do not offer refunds on partial months of service. If you cancel mid-cycle, you retain Pro access until your billing period ends. For annual subscriptions cancelled within 14 days of initial purchase, please contact us at hello@somacomfort.com to discuss your situation.
COSI reserves the right to change pricing with at least 30 days' advance notice to active subscribers.
You agree not to misuse COSI's platform. Prohibited activities include:
COSI may investigate and take appropriate action — including account suspension or termination — for any violation of these acceptable use policies.
COSI owns the platform. All content, software, algorithms, designs, trademarks, and proprietary technology within COSI — including the comfort scoring system, AI models, and user interface — are owned by or licensed to COSI and protected by applicable intellectual property laws.
You own your personal data. Your physiological data, environmental readings, comfort preferences, and any personal information you provide remains yours. COSI's use of this data is governed exclusively by our Privacy Policy.
You grant COSI a limited, non-exclusive licence to use your data solely to provide and improve the services described in our Privacy Policy. We will never sell your personal data to third parties.
COSI is provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by law, COSI disclaims all warranties, including:
COSI is a comfort optimisation tool, not a medical device. Do not use COSI as a substitute for professional medical advice, diagnosis, or treatment.
To the maximum extent permitted by applicable law, COSI and its affiliates, directors, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, loss of profits, or loss of goodwill — arising out of or in connection with your use of COSI.
In any case, COSI's total cumulative liability to you for any claim arising under these terms shall not exceed the greater of: (a) the amount you paid COSI in the 12 months preceding the claim, or (b) $10 CAD.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, COSI's liability is limited to the fullest extent permitted by law.
COSI may suspend or permanently terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms of Service, engaged in fraud or illegal activity, or if required to do so by law.
You may delete your account at any time from Profile → Account Settings → Delete Account. Upon deletion, your personal data will be permanently removed within 30 days, in accordance with our Privacy Policy.
Provisions of these terms that by their nature should survive termination — including intellectual property, disclaimer of warranties, limitation of liability, and governing law — will survive.
These Terms of Service are governed by and construed in accordance with the laws of the Province of Quebec, Canada, without regard to its conflict of law principles.
Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Quebec, Canada. If you are a consumer in a jurisdiction that provides additional statutory rights, those rights are not affected by this clause.
